MUHAMMAD ISHAQ versus MUHAMMAD NADEEM
Criminal Code of Conduct (CR PC) Section 526 Constitutional Code (XLV of 1860), Section 302 Constitution of Pakistan (1973), Article 185 (3) Case transferred to juvenile offenders on the basis of birth certificate, school leaving certificate had gone. The accused complainant's domicile certificate did not challenge the truth and authenticity of the documents before the trial court; the complainant's claim before the Supreme Court was correct that the date of birth of the accused in the certificates was not correct. It was not taken by the High Court that unless the said documents were subjected to fraud or forgery, it was appropriate in these circumstances that the Supreme Court accordingly refused to appeal to the complainant.
