In counting the case, the Chief Election Commissioner had no decisive powers to interfere with the Returning Officer's order that the powers exercised by the Returning Officer were automatically withdrawn from the Constitution by dismissing the dispute and the Chief Election. The commissioner did not authorize them. This should be termed as the inherent authority of the Returning Officer.
