SHADI KHAN versus THE STATE
With regard to the Criminal Procedure Code (CRPC) Section 497 Illegal Weapons Act (XXI of 1991), nothing was available on record on Section 7 bail in which the accused or any ex-convict was convicted It was demanded, therefore, that a person not falling under the purview of section 497 (1), the prohibition clause of the PCP, could not be considered, as the statute itself imposed the amount of imprisonment for the former accused persons. The source was to be regularized when it was considered. The request for bail was not to uphold the maximum sentence provided by law, but the facts and circumstances of the case can give a person bail if the bail is proved a crime.
