MIR SALIM KHAN KHOSA versus CHIEF ELECTION COMMISSIONER

Sections 16 (3) and 37 of the Balochistan Local Government Election Rules, 2000, R57 Constitution Pakistan (1973), Article 185 (3), the Supreme Court of Appeal approved for consideration by the applicant. It was held that the High Division Bench Court not only accepted the applicant's view, nor did section 37 (3) with Section 37 of the Balochistan Local Government Election Ordinance 2000, and R57 of Balochistan Local Government Election Rules 2000. Provided the correct justification, but also observed that candidates must get 476 votes in order to fulfill the condition of more than 50% of the votes returned from the Electoral College. There was, therefore, no reason to reject the constitutional application and to deny relief.
