SHAH GUL versus STATE
West Pakistan Weapons Ordinance 1965 Section 13E Criminal Procedure Code (V9 1898), non-compliance with the directive contained in section 103 103, received a spy report seven hours before the CRPC evidence testimony raid. Police should have at least two respected persons from the area or nearby areas to search for the police, but no attempt was made by either of them, nor did any of the prosecution provide for section 103, CR PC. Provided no justification for non-compliance. Top police officials, including the raiding party and the high magistrate, deliberately violated the essential provisions of the law, and no search warrant was obtained by the concerned police officers or the authorities responsible for conducting the raids and investigations. During the odd hours of the night, the residence of the residents did not exclude the forgery of an alleged Kalashnikov eighteen round of police, even in the absence of any ill will, resentment or molestation. The accused was acquitted.
