IFTIKHAR HUSSAIN BALOCH versus DISTRICT MAGISTRATE, BHAKKAR
Criminal Code of Conduct (CCPC) Sections 494 and 492 of the Police Rules, 1934, Volume 3, Chap 27R4 (2) of the Criminal Code (XLV of 1860), Section 165A / 186/506/109/182/211 of the Constitution Pakistan (1973), deposed from prosecution by Article 199 Inspector Legal, owned by prosecutorial inspectors and prosecution sub inspectors, under sub rule (2) of R4 of Police Rules 1934, was appointed official prosecutor in the locality. Such a law was, thus, not clear and clear with respect to the competence of the prosecuting inspector or the authority to withdraw from the prosecution of the matter which was withdrawn with the consent of the court, according to which the constitutional application was dismissed.
