Section 15 Constitution of Pakistan (1973), Article 185 (3) defaults on the payment of monthly rent by the tenant below the settlement of the premises for the tenant to be accepted by the tenant. There was also a default in payment of rent. The tenant controller established for eviction of the tenants was given an order and such order was upheld by the High Court. The final inquiries of the facts filed by the courts under which the reasonable facts were rejected by the applicants were found to be neither illegal proceedings nor any material irregularities. The Supreme Court rejected the courts below the leave of appeal
