ZULFIQAR ALI KHAN versus ELECTION TRIBUNAL, GUJRANWALA, HAFIZABAD CAMP/DISTRICT AND SESSIONS JUDGE; HAFIZABAD
Punjab Local Government Election Rules 2000, RR 70, 71, 72 and 77 Constitution of Pakistan (1973) Article 199 Constitutional Petition Restoration of Election Petition, bail in the election petition by the default ex-candidate has been removed on this day. When the prosecution was adjourned for hearing because of the absence of the EC, the Election Tribunal refused to reinstate the application on the ground that there was no justification for the restoration of the petition in the Punjab Local Government Election Rules 2000. There was no arrangement or procedure for filing a plea to set aside the previous orders; such a request would not be banned because if it is allowed to be filed it will advance the conclusion of justice. And the election tribunal had demonstrated a very narrow view. In this case and in the process, there was a breach of the Supreme Court's demerit, as reported by HM Sia. Since the order approved by the PLD 1979 SC 65 Election Tribunal was set aside and sent to the trial tribunal for adjudication in the circumstances.
