WASEEM-UD-DIN versus THE STATE
Pakistan Penal Code Section 302 Criminal Code of Conduct (v. 1898), Section 342 Constitution of Pakistan (1973), Article 185 (3) Defendant's plea for the incident and refusal to establish prosecution as the victim was injured by the accused. The accused committed the crime The trial court sentenced the accused under Section 302, PPC and sentenced him to death. The High Court upheld the sentence but changed the death sentence to life imprisonment. The defendant admitted that the defense version was not fully accepted. Accuracy Under the High Court, the courts had long considered the defense plea and rejected it for good reason only when the accused's statement could be accepted only if the evidence of the prosecution in the case had its full status. I was rejected, therefore, by the accused in his statement under section 342, the CCP was not admissible that the decision of the High Court be heard and any interference by the leave of the Supreme Court for appeal.
