Individual Rental Coverage Ordinance 1979 Section 15 (2) (ii) The burden of default proof on payment of rent is for the landlord to determine if the tenant did not pay the rent or took the tender. So if the landlord once stated in the affidavit that the tenant did not pay the rent, then the burden on the tenant would prove that he had paid or paid the rent to the landlord. The person, who examined himself, testified in court that the tenant had failed to pay or tender. The landlord's evidence was irrevocable and the tenant was unable to prove by providing any documentary evidence that he had paid the rent to the landlord.
