THE CHAIRMAN, PUNJAB LOCAL GOVERNMENT BOARD/SECRETARY, LOCAL GOVERNMENT versus THE PRESIDING OFFICER, PUNJAB LABOUR COURT NO.9, MULTAN AND ANOTHER
Punjab Local Councils Service Rules 1983 R, 3 Punjab Local Government Ordinance (VI 1979), Section 44 Punjab Service Tribunals Act (IX of 1974), Section 2 (b) Constitution of Pakistan (1973), Respondents to Article 199 constitutional petition, who was dismissed on the basis of inquiry report of the Chairman Punjab Local Board, filed an appeal before the Additional Chief Secretary, which was dismissed by the Labor Court, accepting review of the dismissal order. In doing so, dismissed the dismissal order and restored the respondent. Its post authority challenged the order in the constitutional petition that the defendant is a civil servant and not an employee, the Labor Court lacks jurisdiction in the matter, who was appointed to the post of sub-engineer in the municipal committee at the time of his dismissal. And was a member of the Local Council Service. And it was enforced by the Punjab Local Council Servants (Appointment and Terms of Service) Rules 1983 and thus it shall not be considered a Government Employee for the purpose of Punjab Service Tribunals Act 1974 nor a Labor Judge approved by the Labor Court. In a case where jurisdiction is lacking, the High Court dismissed it as illegal.
