FRONTIER PROVINCIAL COOPERATIVE BANK LTD. OFFICERS ASSOCIATION (REGISTERED), PESHAWAR versus FRONTIER PROVINCIAL COOPERATIVE BANK LTD., PESHAWAR
Section 48 Constitution of Pakistan (1973), Article 199 Constitution Petition Trust, Roll of Equity and Application of Property was created by the Provincial Cooperative Bank Pension Fund Trust so that its employees receive pension benefits. The Golden Handshake scheme benefited only 13 of the 32 retired employees, who dissolved the trust under the provisions of R-48 of the Co-operative Society Rules 1927, and the applicant who was the remaining 19 retired employees of the Bank. Pension benefits were not given for the purpose for which the trust was properly constituted by the bank the trust was properly constituted and the order passed by the Deputy Registrar in accordance with the law was illegal and the relevant law was invalid. The result of the translation was where the applicants were the only victims of the rule of equity and propriety After compliance with the order issued by the Deputy Registrar, the High Court directed the authorities to provide benefits to the applicants accordingly.
