Arbitration Act 1940 Sections 9 and 33 Insurance Act (I38 of 1938), Section 44B Insurance Claims Arbitration Insurance sought the arbitration clause and appointed the arbitral insurance company in spite of receipt of notice, neither appointed nor arbitrated The sole arbitration insurance company, awarded by the awardee involved in the arbitration proceeding, moved the request for separation of the award under section 33 of the Arbitration Act, 1940. The trial court dismissed the insurance company's request when the insurance company rejected the insured's claim and did not charge any fraud, the trial court's order dismissing the appeal was unimaginable.
