ABDUL KHALIQ versus THE STATE
Criminal Code of Conduct (CRPC) Section 497 Crimes of Adultery (Enforcement Hood) Ordinance (VII of 1979), Section 16 bail accused Although named in the FIR, direct evidence of kidnapping against him is available on record. There was no FIR in which the accused was seen carrying the kidnappers, other than that only evidence was available against the accused which was extra-judicial confession which was a weak type of evidence. There was no reasonable basis for which the accused should believe in joining the commission. The accused was behind bars for more than two months and no more was required for police interrogation. The kidnapper was recovered, but his statement was still listed by prosecution under Section 164, CRPC. No further investigation was needed on the accused's case and he was also admitted on bail accordingly.
