Proof of Case The termination of the FIR of appreciation was against the accused as he had obtained disputed money from the complainant on loan and went abroad and on return he refused to return the complainant's High Court. The complainant filed an intra-court appeal against a single High Court judge's decision, dismissing the FIR against him after accepting the accused's plea. Alleged that he was a friend of the complainant and had received a disputed amount of debt which he had promised to pay back after returning from abroad, in the amount, in the case, the complainant. The bribe was not received by the accused because the accused was not entrusted with the money as a public servant, nor was he mistreated or used or has been converted into his use. But it was borrowed as a friend and the remission of the offense of breach of trust was not eliminated and the section 409, PPC case was dismissed. The case was not covered under AH 420, PPC did not stand against the accused as he had taken the money on loan with the same payment promise to the complainant and if the accused did not withdraw the amount Was denied, he did not commit any crime; if the complainant gets hurt by any of the accused's actions, he can file a case against the accused and seek medical treatment.
