MUHAMMAD IQBAL SAJID versus THE STATE
Pakistan Penal Code Section 302/379/201/34 Defining Evidence There was no conclusive evidence regarding the commission of the crime, except that the last seen evidence of the prosecution witnesses was dismissed by the prosecution's witnesses. Once witnessed the deceased, their evidence was inadequate. Their statements were recorded long after the presence of the prosecution witnesses at the relevant place, neither their evidence was recorded nor was they recorded. Their presence was natural because the two prosecution witnesses were 2 1/2 miles from where the accused obtained the victim's taxi. Two of the prosecution's witnesses, in which the accused allegedly committed extra-judicial confession, were harassed for not supporting the prosecution's version, which in fact caused a fatal blow to the prosecution's version. That is, the statements of the witnesses of the prosecution were not convinced by the trial court in relation to the accused. Those who testify in the absence of any independent evidence say the prosecution's witnesses could not be retained, the prosecutor failed to prove the accused, he was acquitted
