The Constitution of Pakistan 1973 Arts 199 and 185 () was written on a notice of dispute between the parties to recover a bank loan in which the bank petitioner was indebted to the loan, was upset by the notice and asked the High Court to issue the writ. The nature of the prohibition was referred by the High Court, dismissing the petitioner's constitutional petition, rightly stating that the writ of prohibition could not be issued because the bank did not take any adverse action against the applicant. Except that the applicant has issued notice of his position. Along with the answer, the representation, which they sent in response to the notices, which had questions which were decided by the bank officers, was premature in issuing a prohibited writ, as no adverse action was taken against the applicant. Appeal was granted due to reason. Refused in the circumstances
