SHAMSULLAH versus STATE

The defendant was charged with possessing a charge of suspicion of delay in sending a sample to drug (C) drug possession and was sentenced by the trial court under section 9 (c) under the Control of Narcotic Substances Act, 1997. And sentenced to two - The sentence imposed with a fine of up to a year imprisonment was recovered on 22-12 2011 and a sample was received by hand at the Franz Science Laboratory on 1 1 2012, delaying sending the sample to the laboratory. There was a defect in the prosecution's case and it was mysteriously subdued. The accused High Court will retain the conviction of the accused under Section 9 (c) of the Control of Drugs Act, 1997, but the sentence has been reduced and the amount of the penalty appeal shall be reduced. Allowed accordingly
