MUHAMMAD YOUSAF versus PROVINCE OF THE PUNJAB
West Pakistan Muslim Personal Law (Sharia) Application Act 1962 Section 2 Civil Procedure Code (V 1908), O XXIX, Rr 1 & 2 Interim Order, Suit Land Seller's Grant, was the widow of the deceased and was the limited owner. The State transferred the property in favor of the applicants / defendants. Both courts refused to grant interim order to the applicants / defendants. Vendrati's limited property was abolished on 31.12 1962 on the request of the West Pakistan Muslim Personal Law (Sharia). By the act of the Act, 1962, the shopkeeper became a limited owner because his property had expired. The initial liens made by the seller beyond the share of the deceased person's property were invalid and the respondents / defendants did not contest the claim that the applicants / claimants were restricted to the extent of the vendor's share in the suitland. The interim order was given to the extent of the seller's share in the immovable estate.
