Pakistan Penal Code Sections 420/406/403 Frontier Crimes Regulation (III of 1901), Section I1 Constitution of Pakistan (1973), Arts 1 (2) (a) (b) and (c), 247 (7) and 199 (1) (a) (ii) Responding to the Constitution Petition, the Respondent filed a complaint with the Political Agent, North Waziristan under Section 420/406/403, PPC read with Section 11 of the Frontier Crimes Regulation The Assistant Political Agent, 1901, issued notice to the applicants regarding the effect of the complaint on their Lahore address to the High Court through the Assistant Political Agent, the jurisdiction of North Waziristan, the Supreme Court and the Tribunal through the High Court. He had no jurisdiction to cancel the prohibited notice pursuant to Article 247 (7) of the Constitution. The constitutional petition of the areas was consequently rejected because a security warrant was granted for a month to enable the eligible applicants (s) to move their case to a court of competent resolution.
