MEHMOOD KHATOON versus MUHAMMAD KHAN
The Special Relief Act, 1877, Sections 42 and 54 of the Contract Act (IX of 1872), affirming the gift of the claimant and the affirmation of a gift to the three rulers, who were the mother of three sons, allowed the brother-son's sons to land in the dispute. Was denied. It is stated that the conversion of the gift certified by him to the defendants was illegal. The cross-examination did not suggest that the plaintiff had given the alleged gift out of love and affection for the defendant; that he had declared the alleged gift and that the defendant had accepted it as well. Thumbs were marked on the alleged gift variation and proof of the gift would not be substituted as considered in section 25, the Contract Act, 1872 Or are Muslim lawfully gifted components that declare the gift through the donor, accept the gift by the donor, and provide the donor with the gift.
