A & BEVERAGE SHAMA LABOUR UNION 404-406, INTERNATIONAL AUTO PARTS, KARACHI versus SINDH LABOUR COURT NO.3
The Constitution of Pakistan 1973 Article 199 Constitutional application disobeys the directions / observations given by the High Court while the subordinate court in the previous constitutional petition rejects the improper order while seeking remand of the High Court case and also the Presiding Officer of the Labor Court. Gets remand for decision making. In light of the directions / observations given by the High Court in its order, the Labor Court had to comply with the letter and spirit on the remand order, but it failed to do so by disregarding the directions / observations of the High Court and thus the case. The decision was not valid. Under the law, the remand order was passed by the High Court on merit, but the Labor Court, instead of following the High Court's instructions, sought to find the same error, dismissing the Labor Court's conduct as inappropriate. The contempt of court was granted and on the remand of the case by the Labor Court, as per the order of the High Court, the matter was set aside and the matter was remanded to different Labor Courts so that it could decide according to the law.
