The record on the evidence proves that the defendant had physically occupied the land in the dispute, the order passed by the Board of Revenue had the finality of the respondents' rights and he was never challenged before any higher forum. As shown in the petition filed under section 12 (2), CPC, the same was rejected by the High Court under OVL, R 11, CPC.
