PUNJAB PROVINCE versus CHAUHAN & COMPANY
Sections 31 and 39 of the Arbitration Act, 1940, by the court to examine the suitability of the award, constitution of the case and canceling the objection without recording the evidence. Violated objections dismissed. The Arbitration Act, 1940 was bound to scrutinize the award; if anyone suffered a mistake, mismanagement and error of law, even though no objection was filed, the court was also bound to consider whether to send the award. Whether or not the court has not presented the issue of extra importance and objections against the award seriously, the High Court ordered the court to award the award as a court award.
