AMIR MALIK versus GOVERNMENT OF SINDH
Articles 133, 134 and 137 of Pakistan's Criminal Code (CCPC) Constitution of Pakistan (1973), Article 199, a conditional order for the abolition of malice, was allegedly barred by the magistrate for filing an objection against such order. The sanction was granted against the applicant for removal of the magistrate. It was required under section 137, CCPC to conduct an inquiry through the recording of the evidence, but they passed the final order without having to make an inquiry order through a magistrate under section 133, CRPC seeking evidence in this case. Subsequent to the Tender Section 137 provided that there was no evidence to be recorded by the magistrate before passing the CCPC final order, the High Court had set aside the impugned order and strict the relevant law. After receiving the remand, a remand for the case was obtained.
