But the accused was in constant custody but the trial did not end. The stolen property was not recovered from the accused and the complainant could not identify the accused in court. The accused's name was not listed in the FIR and was arrested by the police. The refusal of the defendant's bail from the release of the accused on the partner's bail is discriminatory and he was to be treated equally with the co-accused. Further investigation into the accused's case is needed and as such, the principle of consistency was entitled to bail, in which case the accused was allowed to bail.
