TAUSIF HUSSAIN SHAH versus DISTRICT MAGISTRATE, CHAKWAL
Constitution of Pakistan Section 30, Articles [Police (Punjab Amendment) Ordinance (Amended by VIII of 1984)] Constitution of Pakistan (1973), Arts 20 and 199, Constitution Petition Requesting Extraction of Alam Procession License by the People of the Shia Sect The petitioners prayed that the district administration and others should refrain from resisting the procession from a particular place in the village and the administration should decide the issue of the procession. The applicants were of the view that the District Administration, which did not authorize Section 30, Police Act 1861, would deny the grant of license to withdraw the procession as it would violate the provisions of Article 20, the Constitution of Pakistan (1973). It is argued that due to the law and order situation in the area, applicants cannot be allowed and with this grant. Having a licensed evacuation license would worsen the situation and cause riots, especially since most residents of the village were followers of the Sunni communal district administration under section 30 of the Police Act, 1861. , Was authorized to refuse the required license if it was satisfied that the license was in breach of the license. Justification of peace In the present situation when disputes between the two sects were promoting the grant of licenses to the applicants, the administration would be subject to unnecessary interference in the affairs of the High Court; there was no material on record to disagree with the administration's opinion. In the event, it cannot be substituted. Opinion in exercising its constitutional jurisdiction
