Pakistan Penal Code Section 302/34 Constitution of Pakistan (1973), Article 185 (3) The accused admitted that the statements of only two witnesses were recorded after the delay of about five to five months after the date of the incident. Judicial confessional statements were shown by the accused, but it was recorded ten days after the arrest of the accused. That the statements of the accused were not recorded in accordance with the provisions of Section 342, CCPC, and that the courts below failed to review the defense version in the prosecution case, and that the whole reason was for the accused to be prejudiced. Appeal was granted. Supreme Court to examine the facts and re-examine the evidence in the case
