Failed to submit an application for leave. On receipt it was stated that the defendant (appellant) requested that he could not tile the petition to defend the case as he had moved to a very remote place where he had arranged for his sister's marriage arrangements. I was engaged and his brother was unable to deny it. The defendant, where the plaintiff was engaged, was beyond the reach of his brother, the defendant had failed to produce any evidence to show that he was indeed trapped at such a remote location as his brother defendant. Was beyond the reach of the defendant who failed to defend the case, the plaintiff's bank case was properly ordered based on the evidence on record.
