HAROON-UR-RASHEED versus RAFHAN MAIZE PRODUCTS CO. LTD.
Industrial Relations Ordinance 1969 Section 25 West Pakistan Industrial and Commercial Employment (Standing Orders) Ordinance (VII 1968), Sections 15 (3) (b) and (4) Constitution of Pakistan (1973), Article 13 accused of dismissal from employment. The criminal proceedings and the prosecution proceedings against the employer issued a charge sheet against the employee and a lawsuit was also filed against him. The employee pleaded that he was acquitted of theft charge against him in the appeal, violation of the employer's prosecution Article 13 of the Constitution of Pakistan (1973), because the termination of employment was canceled. The proceedings and departmental proceedings can proceed as well and may result in different conclusions.
