The defense application filed by the defendant / landlord is pending for four years and the tenant is present for nine years. They were not on record in support of his contention that the documents intended to be brought on record by the tenant were not available at the time of his leading evidence because he had no additional evidence to support the application for additional evidence. In the absence of a valid reason, he said the application was rightly rejected, especially when the documents were intended. Additional evidence should be presented because the facts of this case are inconsistent.
