QAMAR QAYYUM versus ADDITIONAL DISTRICT JUDGE, KASUR
Lawsuit filed against a petition filed by a pre-emptor under sections 6 and 35 of the Punjab Pre-Emission Act 1991 (Constitution of Pakistan) (1973), Article 35 for restoration of Article 199, neither of the tender court. Neither was the case before, nor was the appellate court before, saying that the matter had not been raised before, so it cannot be allowed to appear before the High Court for the first time in a constitutional petition, as the applicant is not allowed to appear before it. Due to his conduct, he was requested to argue at this point in the courts below the applicants. Failing to disclose any of the errors approved by the appellate court below, it said that this order would not demand the intervention of the High Court in exercising constitutional jurisdiction.
