SUO MOTU CASE NO.16 OF 2011 ALONG WITH CMAS versus
Sections 3, 12 and 25 of the Constitution of Pakistan, Article 184 (3) in relation to the law and order situation in Karachi, by the party v. Federation of Pakistan (PLD 2011 SC-997), in the case of the Supreme Court. Implementation of the Decision The unauthorized encroachment on public land and the Supreme Court observed that it was quite possible to identify those lands which were unauthorized occupation / encroachment. It is unclear whether the cases listed under the Sindh Public Property Act 2010 could be dealt with in the Class A or C. The Supreme Court directed that the (Provincial) Board of Revenue should collect information on a regular basis. Satellite imagery for the whole of Karachi to identify land boundaries. That the relevant cell officer should submit its report within 7 days and indicate whether the encroachments by the land occupants were removed within its jurisdiction. Such reports should state the details of each case, which was dealt with as either a \ A \ or a \ C \ class during the investigation, and the cases that were dismissed. That the Prosecutor General may also, with his remarks, separately present the details of such matters, which also state whether further action has been taken by him and if there has been a failure of evidence in the case. So he should take responsibility for it. Investigation team or other relevant persons, and should further identify whether the properties in the occupation of the encroachment / land occupants were reclaimed or were still in unlawful occupation.
