THE STATE versus GUL KHAN-
Under Section 249A, CRPC, the accused was acquitted by review against sections 249A, 417 and 439 of the Code of Criminal Procedure (CCPC), CRPC filed a review petition by the accused. The acquittal reinforced the initial concept of the defendant's innocence and, thus, could have been interfered with by the High Court when such order was based on evidence or based on irrational grounds. He was neither obedient nor confused. No interference was sought as the trial court was not authorized to modify such order by any illegal and material irregularities.
