The petition for leave to appeal for the allotment of the Constitution of Pakistan 1973 Article 185 (3) residential quarters was not made a party to the proceedings before the High Court and the effect of the Supreme Court was that the petitioner had already seized a quarter to his right. The earlier order was signed by the Allies of the Controversial Quarter, without granting it an opportunity to be heard, after having passed such an order on the misrepresentation of the State Officer, by the leave of the High Court. It was determined that the appeal was refused.
