Criminal Code of Conduct (CR PC) Section 426 of the Criminal Code (XLV of 1860), Section 406 Constitution of Pakistan (1973), Article 185 (3) The convict / offender was sentenced to three years imprisonment. But the appellate court extended the applicant's sentence by five years. The RIT Petitioner filed an appeal against the sentence and sentence before the High Court along with the request for suspension, but the High Court refused to suspend the petitioner's sentence as the petitioner was short and was below. I raised the appellate court, the case was appropriate in which the High Court should have used its discretion in favor of the applicant / offender.
