HOTEL SUMMER RETREAT, NATHIAGALI versus GOVERNMENT OF N.-W.F.P.
Article 107 Constitution of Pakistan (1973), Article 199 of the Property Act 1882, Article 99 Constitutional Appeal was the highest bid submitted by the applicant in connection with the lease of the hotel to exempt Lux Standi from the constitutional jurisdiction and was authorized by the authorities. Was not rejected. Instead of accepting the bid offered by the applicant, the highest bid was started with someone who has not even participated in the tendering process. The legal authorities were legally and morally obliged to perform their duties in a fair and transparent manner and any deviation from there would make the affected / applicant a victim. The procedure adopted by the Authority was an "affecting person" who was unreasonable, unfair, arbitrary and discriminatory, having access to the Hands Court Luxury Standing and the request for a felony's mandamus / certification jurisdiction. Was standalone. The other legal remedy avai condemned for it, was the unconstitutional attempt by the powers to request the constitutional jurisdiction of the Lux Standing High Court to negotiate the higher bid offered by the applicant who sought tendering. Did not participate in the proceedings, was declared illegal under the circumstances
