ADAMJEE CONSTRUCTION COMPANY LTD. versus GOVERNMENT OF PUNJAB
Relations to the High Court Rules (Volume IV) Volume 1, Chapter 16 Civil Procedure Code (v. 1908), O III RR 1, 2 and 4 Counselors and Clients, Application for Rehabilitation of the Case, were filed in the trial court. The applicant, who was not appointed by the client's lawyer to the position of lawyer, was prosecuted and, as such, his duty was not questioned by the client. The assumption was not that the lawyer's action on behalf of his client is equivalent to endorsement by him. The provisions regarding the client's appeal / offer were according to nature and could not be removed with the maximum penalty of dismissal due to non-compliance. Any such defect was irregular and can be verified by providing the relevant party with an opportunity to do so. Therefore, the trial court's order was dismissed by the High Court in review.
