Sections 67, Election 67 and Election 70 declared the election completely null and void, not satisfied with the unofficial result under which the respondent was declared successful, filed for re-counting of votes. The petitioner first alleged that the Election Commission's directive under which the Returning Officer was directed to complete the count in one sitting was clearly violated because the Returning Officer had completed the count in eight. Days were spent Secondly, the re-enumeration was done in slip and the envelopes containing the applicant's ballot papers, which were missing from the five polling station bags, but the returning officer did not care to trace them on the basis of re-counting. The disappearance of the ballot papers was proved not only through oral and documentary evidence but was also denied by the candidate, the number of missing ballot papers was counted five hundred and the returning candidates Had won the election by a margin of light.
