Under Section 41 of the Property Act 1882, the buyer / buyer inquiries filed a lawsuit in the name of the owner appellant, in which the declaration of ownership of the land demanded that the appellant's brothers sell the land in excess of their shares in the dispute. The buyer of the sale pleaded that he was a defective buyer and that the record of the evidence on the Re record purchased only after the land did not prove that the trial court ruled in this regard on the question of title to the land. But the lower appellate court made the disclosures concerning the stability of the trial court under section 41, transfer Reversed. The Property Act, 1882, was only available where it was proved that the purchase was for consideration and proper care was taken to ascertain whether the transfer was authorized.
