Prior to Articles 6 and 13 of the NWFP Pre-Emission Act 1987, the lawsuit was not mentioned in the case, time, place and date of the student's residence, but the evidence was recorded by the defendant in the evidence filed during the trial. The effective question of making the student a pure question of fact in the case had to be mentioned in court and it would not be permissible for the plaintiff to give evidence by presenting the evidence without first mentioning it in the suit filed by the plaintiff. Things were rightly dismissed on the grounds that the student was not made according to the law.
