The Applicants Act, 1882, Section 28 and 37 of the Cantonment Act (II of 1924), Section 116 (h) Constitution of Pakistan (1973), Article 185 (3), applying for the right to extinguish the flyover in favor of construction of the said bridge / The construction of the bridge was a challenge. In this constitutional jurisdiction of the High Court, after considering the case of the applicants, it was decided that their right to ease was in their constitutional jurisdiction. The parking lot was not of a nature that would not accept interference / regulation to meet the traffic needs of the city's five million residents. The applicants did not claim that the appropriate authorities had completely extinguished their easement rights. In this decision, the observations made by the High Court, which was contrary to the rule of law on the subject, were not involved. In the intra-court appeal, the High Court reduced the ease of parking strip by the applicants. Was properly considered in favor of any future claim for damages due to this and in the intra-court appeal, such observations of the High Court did not show any victim of fraud. Any appeal that was filed to appeal the High Court decision was dismissed in the circumstances
