IFTIKHAR AHMAD versus GHULAM RASOOL
Section 14 of the Azad Jammu and Kashmir Courts and Rules, 1949, Section 31 of the Azad Jammu and Kashmir Interim Constitution Act (VIII of 1974), Section 42, was filed by the Additional District Judge as invalid. Plaintiff's return was filed by the plaintiff as was transferred in accordance with the High Court order and the Plaintiff filed a request for transfer as well as within seven days of the High Court's return order. The affidavit in the Judge's Court implies that the plaintiff cannot be returned to the plaintiff due to the absence of the Additional District Judge, so the plaintiff will be presented after his return. The Sub-Judge waived the delay until the due date; upon joining the duty by the Additional District Judge, the Plaintiff filed a petition for the return of the Plaintiff which was returned and on the next date of Return, the Plaintiff filed a Sub-Judge The same was filed earlier, which dismissed the case as being prohibited by the plaintiff. He was not negligent because he ordered the High Court to return the plaintiff within seven days and return before all the judges.
