MUHAMMAD IMTIAZ KHAN versus AZAD JAMMU AND KASHMIR GOVERNMENT
Azad Jammu and Kashmir Civil Servants (Appointment and Regulations of Services) Rules 1977 Rr 9, 10A, 10B & 13AJ Appointment of the Jammu and Kashmir Interim Constitution Act (VIII of 1974), Appeals for Sections 42 and 44 Appeal for the Post After the Electric Inspector B17 was vacated, the Authority forwarded it to the Public Service Commission, which advertised that the Post Appellant, who had fulfilled the required qualifications in the Public Service Commission in response to the advertisement, sent these candidates Call letters were also issued which included the appellant and a date was set for the interview. The letter to the Deputy Director of the Public Service Commission (Examinations) was written by the Authority to postpone the election for the controversial post as the relevant appointment rules are being amended by appellant who filed a constitutional petition against the postponement. The hearing was dismissed by the High Court which was merely a filing. The Public Service Commission does not have any right to apply. The Public Service Commission shall consider the advertising post. The Public Service Commission began the selection process through a controversial post and the appellant formally applied to the Public Service Commission regarding the controversial post which was not withdrawn by the authority, a right appeal The holder was to be considered for appointment at the time the post was advertised that the High Court found that it was not in the interest of anybody to submit a petition to the Public Service Commission only. Considered for the advertised post of the Public Service Commission, the wrong order passed in the constitutional petition by the High Court was rejected by the Supreme Court on appeal.
