BABAR KHAN GHORI versus FEDERATION OF PAKISTAN
Sections 2 and 3 of the Pakistan (Control) Ordinance 1981 and the Constitution of Pakistan (1973), Arts 2A, 4, 9, 15, 25 and 199 exit the constitutional request that the Pakistan (Control) ordinance be removed at the touchstone of 1981. The wires were challenged. Its alleged incompatibility with the Fundamental Rights Restitution Ordinance was not included in the Seventh Schedule to the Constitution of Pakistan, and as such, it is a common law applicable to amendment or annulment by the legislature, as Article 270A (6). Due to its alleged incompatibility with the fundamental rights, the wiring of the constitution, the ordinance could be examined and the constitutional petition was protected.
