MISRI versus STATE
Criminal Code of Conduct (CCPC) was granted bail for the accused in a murder trial before the trial court on the charge of forfeiture of section 514 of the Code of Conduct (XLV of 1860), section 302/34 bond. After the absconding, the accused was presented. Applicant's bail in the custody of the person who was responsible for presenting them to the court if required and when he failed to find the accused under the law, then finding the accused's failure, thus excluding the bail. There was no basis for doing so. The Penalty Trial Court's order to collect the 50 reduced bond bail was neither approved in a hurry nor after considering every aspect without giving it a reasonable opportunity to hear the unexpected order in the circumstances of the case. It was neither strict nor illegal that the trial court had already taken an effective view on the matter in which the review petition was dismissed.
