REFERENCE MADE BY D & S JUDG versus THE STATE
Sections 435/438 and 526 (1) (a), (c) of the Code of Criminal Procedure (S), by the Sessions Judge in the reference given by the Sessions Judge to transfer the murder case from his file. Chose not to prosecute the murder case. In the case, he submitted a reasonable report for his transfer from his file, which is already listed in the case when a judge did not want to proceed with the case for any reason which led to his disclosure. Unless necessary, they may not be able to succeed in this matter until then, neither reveal the reason nor refrain from expressing it as the matter progresses, even though the matter is referred to in Section 526. (1) (a) and 526 (1), (c), were covered by the CRPC. Given the specific circumstances of the case, the case was moved to a second session judge's court in the interest of justice with special instructions.
