GOVERNMENT OF N.-W.F.P. versus MUHAMMAD FAROOQ

Land Acquisition Act 1894 Sections 23, 24 and 28 [Land Acquisition (North West Frontier Province Amendment) Ordinance (By V of 1983)] Constitution of Pakistan (1973), Article 185 (3) Increase of Compensation to Paying Landlords In addition to the acquisition of their land, keep the three schedules by the referee judge validating the question until the receipt of the money on different dates of occupation of different assets with 15% mandatory acquisition compensation as well as 8% domestic interest. No exceptions can be made. Average prices were worked out by patwari which is not a violation of any matter considered for determination of compensation under Section 23, Land Acquisition Act, 1894 and which was to be neglected under section 24 of the Act. I did not identify any justification. However, the referee J had a legal error in paying 8% of the annual interest on the surplus amount and the High Court made compound interest. Was set aside to the extent and the landlords were awarded simple interest. On that day, the rate of 6% per annum on the surplus money was collected when the collector seized the land till the payment date. Appeal for leave denied.
