I did not identify any justification. However, the referee J had a legal error in paying 8% of the annual interest on the surplus amount and the High Court made compound interest. Was set aside to the extent and the landlords were awarded simple interest. On that day, the rate of 6% per annum on the surplus money was collected when the collector seized the land till the payment date. Appeal for leave denied.
