ABDULLAH KHAN versus STATE

Sections 302, 306 and 308 of the Constitution of Pakistan (1973), Article 185 (3) argued that at the time of the murder of the victim, a 2-year-old daughter was a child who was the victim's guardian and also the offspring of the accused. And, as such, the accused was not responsible for the offense on the basis of section 306, PPC, and could only be sentenced to up to 14 years as given under section 308 (2), PPC's appeal.
