The employees of the Constitution of Pakistan 1973 Section 44 Punjab Service Tribunals Act (IX of 1974), Section 4 of the Constitution of Pakistan (1973), Arts 199 and 212 Local Council Service are considered to be public servants for the purposes of the Punjab Service Tribunals Act 1974. The employee of the Local Council Service High Court has suspended the employee transfer order approved by the competent authority regarding the transfer / posting of the employee's confession made in the constitutional application relating to the terms and conditions of service. Such dispute shall be exclusively within the jurisdiction of the Service Tribunal. In the matters of Article 212 of the Constitution it is clearly indicated that the High Court did not consider this aspect of the matter before passing the order in question; the application for leave of appeal was turned into an appeal, And the High Court was remanded with instructions to decide the matter. For the first time before any interim order has been issued, the adjournment issued by the High Court was set aside.
